Terms and Conditions
These Terms and Conditions ("Terms") govern your use of Next Break (the "Service"), operated from nextbreak.com.au ("we", "us", "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. What Next Break is
Next Break helps you plan around a fixed work roster (e.g. FIFO swing patterns) by projecting your upcoming breaks and surfacing flight options, event listings, and bookable or free things to do for those dates and near your hometown. It is an informational and planning tool only, not a travel agency, booking service, or financial or legal adviser, and nothing on the Service constitutes professional advice.
2. Affiliate links and how we make money
Next Break earns a commission when you book a flight, activity, or event ticket through a link on the Service, via our affiliate partnerships with Travelpayouts/Aviasales, Viator (bookable local activities, owned by TripAdvisor), and Ticketmaster (through Ticketmaster's Affiliate Program, administered via Impact). This doesn't cost you anything extra. The commission is paid by the airline, OTA, activity operator, or ticketing provider, not by you. We do not receive payment to favor one airline, destination, or event over another; options and events are selected by price, route, and date-matching criteria described on the site, not by commission rate.
3. Prices, availability, and bookings
Flight prices shown come from a cache of recent fare searches, not a live quote. They reflect what a similar search recently returned, not a guaranteed price for your exact dates. Event and activity listings, likewise, reflect what our partners' public data returns at the time of the request, and can change or sell out at any time. Some destinations are shown with no price at all — just a link to a live Aviasales search for your exact dates — when we don't have a matching cached fare for that route; these work the same as any other link on the Service and are still affiliate links.
- Always confirm the final price, dates, and terms on the booking partner's site before paying. We do not control or guarantee pricing, availability, or booking conditions.
- Once you click through to book, you're dealing directly with that airline, OTA, activity operator, or ticketing provider, under their own terms, privacy policy, and cancellation/refund rules, not ours.
- We are not responsible for cancellations, delays, refunds, price changes, or any other issue arising from a booking made with a third party, even one reached via a link on the Service.
4. Your account
- You can use the Service without an account (settings are then stored locally to your browser), or create an account (email/password or Google Sign-In) to save your setup across devices.
- You're responsible for keeping your password confidential and for all activity under your account. Tell us if you suspect unauthorised access.
- Provide accurate information (in particular, your email address) so we can identify your account and, if needed, help you recover it.
- One account per person is expected; don't create accounts to impersonate someone else or to abuse the Service.
- We may suspend or terminate an account that we reasonably believe is being used fraudulently, abusively, or in violation of these Terms.
5. Break reminder emails
If you opt in (at signup or any time from your profile), we may send you an email reminder in the days before an upcoming break, summarising real flight options, events, or things to do for that break. These are tied to your own upcoming breaks, not a fixed marketing schedule, and we'll never send more than one reminder per break. Every reminder includes a working unsubscribe link that takes effect immediately, no account access needed, consistent with the Australian Spam Act 2003.
6. Acceptable use
You agree not to: use the Service for any unlawful purpose; attempt to interfere with or disrupt the Service (including its APIs or infrastructure); scrape or bulk-extract data beyond normal personal use; or attempt to circumvent the affiliate links (e.g. to redirect commission elsewhere) or otherwise abuse the affiliate relationships that fund the Service.
7. Your data and privacy
We store the roster/setup information you provide (hometown, home airport, roster pattern or manual break dates) and, if you create an account, your email address and a securely hashed password (we never store your password in plain text and cannot see it, even internally). This data exists to make the Service work, showing your breaks, options, events and activities, and is not sold to third parties. Full details of what we collect, why, who we share it with (including overseas providers like our flight, event, and activity data partners), and how to access, correct, or delete your data are in our Privacy Policy, which forms part of these Terms.
8. No warranty
The Service is provided "as is," without warranties of any kind, express or implied, including as to accuracy, availability, or fitness for a particular purpose. We don't guarantee the Service will be uninterrupted, error-free, or that any specific option, price, or event will be available when you look for it.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising from your use of the Service, including losses connected to a booking made through a third-party link. Nothing in these Terms excludes or limits any guarantee, right, or remedy you may have under the Australian Consumer Law or other law that cannot lawfully be excluded.
10. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we'll update the "Last updated" date above, and where practical, ask existing account holders to re-accept before continuing to use account-based features. Continued use of the Service after a change means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of Western Australia, Australia, without regard to conflict-of-law principles, except to the extent a mandatory consumer-protection law of your own country or region applies and cannot be excluded.
